On Manitham's Petition, NHRC seeks report on 2 Tamil Scholars and other 11 Tamils hailing in Bangalore Central Prison for more than 3 years
[NHRC Directs Inspector General of Prisons, Government of Karnataka to submit report within four weeks]

The National Human Rights Commission [NHRC] has directed the Inspector General of Prisons, Government of Karnataka to submit report within four weeks on the alleged arrest of 13 Tamils in Nov. 2002. A copy of the direction has also been sent to the Inspector General of Prisons, Government of Karnataka. The Commission also cautioned that if report has not filed within the prescribed time, it may proceed to take such action as it deems proper.

The direction came in the wake of a petition filed by the Manitham - Human Rights Organisation, represented by its Executive Director, Mr. Subramanian. G, before the Commission on 8th July, 2005. The petition based on in-depth study of the case and meeting various personalities including some family members of the accused.

Tamil scholar Mr. Guna Seelan [a] Bangalore Guna [65], Tajore Tamil University Tamil Prof.K. Nedunchezhian [55] and 11 others were arrested by Frazer Town Police Station, Bangalore, charged as :

- Sympathizing with Tamil population living in other States in India to fight covertly with Non-Tamils and process to create a separate nation for Tamil community.
- Stanch sympathizers and following the principles and ideology of LTTE.
- Acquires explosive substances, clandestinely manufacturing improvised explosive devices.
- Conspire to spread hatred between Tamilians and Kannadigas and to foment linguistic disharmony and to destablish the government and disturb public peace and tranquility at large.

Police framed allegations on committed offences under 120B, 121, 121A, 122, 124A, 153A and 153B of the Indian Penal Code and Sections 3, 4, 5 and 6 of the Explosives Substance Act, 1908 and Section 5 R/W 9(B) of the Explosive Act, 1884 and Sections 3, 7 and 25 of the Arms Act, 1959.

According to the petition, Bangalore Guna [A-10 as per Charge sheet] and Prof. Nedunchezhiyan [A-15 as per Charge sheet] are prominent writers and their research and writings are professionally of high standard. Their writings have attracted hundreds of Tamil intellectuals and youths. Their books had the Potential for dethroning oppression ideologies.

Bangalore Guna, in his life span gave voice to voiceless. He exposed the ruthless manner in which racism practiced against Tamils.

Prof. Nedunchezhiyan, is a Research Scholar in Tamil University at Tanjore, Tamil Nadu. His wife and children are living in Trichy. The Karnataka police actually picked him up at his residence after his early morning walk on July 4th 2003. While it is said that the local Tamil Nadu police refused to give due permission on his arrest, the Karnataka police detained and lied to the press that he was arrested in a hide-out in Bangalore. Prof. Nedunchezhiyan brought proofs from the University to say that he had the copy of the University registers singed till the last day of his arrest.

Bangalore Guna and Prof. Nedunchezhiyan were never involved in any of the Arms struggle or violence by using explosives and arms. The allegations contained in the charge sheet are false and no prima facie evidence in support of police allegations. The arrest is nothing but an illegal detention of Bangalore Guna and Nedunchezhiyan, It is yet another cogent sign that Tamils continue to face merciless suppression under the Karnataka Government machinery.

Several of their bail and discharge petitions had been rejected by the Karnataka courts and they languish in the jail for three years.

Manitham has preyed NHRC through the petition;

a) The arrested persons having their right for speedy trail as per Constitution of India. In this case, even after 3 years, the court has not taken the case for trial.
b) The arrested persons applied for bail and discharge several times, but to reject every time, sometimes deliberately reserved the judgments for several months, throwing spanner into the wheel of justice.
c) It is also said the arrested were facing sever mental and physical torture under police / judicial custody. Due to this, A-1, Vijaya Murthy [a] Murthy [a] Viji aged about 45 died in the jail on 10-06-2005.
